Employers are responsible for their employees' health and safety.

Safety at work is a paramount obligation for employers. Under this obligation an employer may somtimes prevent an employee from entering into the premises for his or her safety or health with a view to avoiding the employer to breach his obligation giving rise to an inexecusable fault. 

Therefore, injured employees and those with an occupational disease, or their heirs, can receive full compensation if employers breach their health and safety obligations. When the employer breaches his statutory health and safety obligations, he is liable (on ne parle pas d' obligations contractuelles en droit anglais). The employer should have been aware of the danger and should have taken the appropriate steps/measures to prevent the employees' exposure.
